Terms and Conditions of the promotion “Floor Days at Mexen”

§ 1 PRELIMINARY PROVISIONS

  1. These Terms and Conditions set out the rules of the promotion named “Floor Days at Mexen”, hereinafter the “Promotion”.
  2. The organiser of the Promotion is:

    hereinafter the “Organiser”.

  3. The Promotion is valid in the online store operated at:
    Mexen – www.mexen.mt
  4. The Promotion is valid from 30 September 2026, 00:00, until 13 October 2026, 23:59:59, or until stocks run out (hereinafter: the “Promotion Period”).
  5. A condition of using the Promotion is reading and accepting these Terms and Conditions. By taking part in the Promotion it is presumed that the Participant has accepted these Terms and Conditions.
  6. A Participant is any customer of the Mexen store who purchases Promotional Products in the Mexen store during the Promotion Period.
  7. A Customer is a person who purchases a Product via the Online Store, concluding a Sales Agreement, and who has legal capacity to perform the relevant act in the Online Store. A Consumer is a natural person concluding a legal act with a trader that is not directly related to that person’s business or professional activity. An Entrepreneur is a Customer who is not a Consumer and who concludes a Sales Agreement with the Seller for purposes related directly or indirectly to their business or professional activity.
  8. This Promotion is not a lottery or a betting game whose result depends on chance (a draw).

§ 2 DETAILED TERMS OF THE PROMOTION

  1. The Promotion applies to the purchase of products in the Mexen store marked on the product page with the information: “Dni Podłóg” / “Floor Days” (hereinafter: “Promotional Products”), which are available exclusively in the FLOORS category.
  2. All Promotional Products will be placed on the Mexen store website during the Promotion and marked with a promotion badge.
  3. The Promotion consists in granting a fixed-amount discount on products from the categories:
    1. floor and wall tiles,
    2. floor panels
    (hereinafter: “Promotional Products”).
  4. Promotional Products are products from the categories indicated above that are additionally marked with the “Dni Podłóg” / “Floor Days” badge.
  5. The discount is calculated according to the following thresholds:
    1. €49 discount for every €350 spent,
    2. €98 discount for every €700 spent,
    3. €147 discount for every €1050 spent,

    and so on (the discount is applied repeatedly, in proportion to the basket value).

  6. Conditions for calculating the discount:
    • a) The discount is calculated solely on the value of Promotional Products in the basket.
    • b) The minimum amount of €350 must be reached solely by Promotional Products.
    • c) The discount may be used solely on Promotional Products.
    • d) Products outside the indicated categories are not counted towards the discount threshold and are not covered by the discount.
  7. The discount is calculated automatically in the shopping basket and is visible before the order is placed.
  8. Discounts are calculated on the current prices visible on the website at the time the order is placed.
  9. The Promotion may be combined with other promotions in the store, unless the terms of those promotions provide otherwise and unless the discount mechanisms are mutually exclusive.
  10. The discount amount:
    1. cannot be exchanged for a cash or in-kind equivalent,
    2. cannot be transferred to another order.
  11. The Promotion applies exclusively to sales made directly by the Organiser through the online store www.mexen.mt.
  12. If an order or part of an order is cancelled, the discount is recalculated according to the current value of Promotional Products in the basket.

§ 3 COMPLAINTS CONCERNING THE PROMOTION

  1. Complaints concerning the Promotion may be submitted to the e-mail address [email protected] or to the correspondence address MEXEN Sp. z o.o. formerly “AGRAF” - KIESZKOWSKI RAFAŁ, ul. Strażacka 6, 05-084 Leszno.
  2. The Seller recommends that the Participant include in the complaint description: (i) information and circumstances concerning the subject of the complaint; (ii) the Participant’s request; and (iii) the complainant’s contact details – this will facilitate and speed up the handling of the complaint. The requirements in the preceding sentence are a recommendation only and do not affect the validity of complaints submitted without following that recommendation.
  3. Complaints will be handled within 14 days of receipt.
  4. The Participant will be notified of the outcome of the complaint by a reply sent, depending on the chosen form, in writing or to the e-mail address from which the complaint was submitted.
  5. In addition, the Consumer has the following example options for using out-of-court complaint and redress procedures:
    • a. The Consumer is entitled to refer a dispute arising from the Sales Agreement to the Malta Competition and Consumer Affairs Authority [MCCAA] or another competent Maltese ADR body.
    • b. The Consumer may contact the MCCAA or another competent Maltese authority to initiate mediation between the Consumer and the Seller.
    • c. The Consumer may obtain free assistance from the European Consumer Centre Malta or from organisations whose statutory tasks include consumer protection.
    • d. The Consumer may submit a complaint via the ODR online platform: https://ec.europa.eu/consumers/odr/ The ODR platform is also a source of information on out-of-court dispute resolution methods that may arise between traders and Consumers.
  6. Use of the out-of-court procedures described in point 5 above is voluntary. The provisions of these Terms and Conditions concerning out-of-court dispute resolution are informative and do not constitute an obligation of the Seller to use them. The Seller’s statement of consent or refusal to take part in consumer ADR proceedings is made on paper or another durable medium if, following a complaint submitted by the Consumer, the dispute has not been resolved.

§ 4 PERSONAL DATA PROTECTION

  1. The controller of Participants’ personal data is the Organiser. The processing of Participants’ personal data takes place in accordance with applicable law and with the Organiser’s privacy policy available during the Promotion Period on www.mexen.mt.
  2. Participants’ personal data are provided voluntarily, but providing them is necessary to enable the purchase of products under the Promotion.

§ 5 RIGHT OF WITHDRAWAL

  1. Where a Promotion Participant who is a consumer purchases a Product under the Promotion in the online store www.mexen.mt, they have the right to withdraw from the sales contract within 14 days of receipt of the parcel without giving any reason. To meet the deadline it is sufficient to submit a statement of withdrawal. Matters of withdrawal from a distance contract are set out in the online store’s terms and conditions and in the section available at: https://mexen.mt/returns, subject to the conditions below.
  2. Partial or complete withdrawal by the Participant from a distance sales contract concluded under the Promotion may result in the loss of Discounts granted to the Participant by reason of participation in the Promotion.
  3. The Participant is obliged to return all granted Discounts or other benefits that are no longer due as a result of withdrawal from the contract.
  4. Where products delivered under one sales contract include Promotional Products, and partial withdrawal means that the remaining Promotional Products no longer meet the conditions for the originally calculated discount, the discount will be recalculated according to the current value of Promotional Products in the basket, and the refund amount will be adjusted accordingly.
  5. The above assumptions in no way limit the Participant’s right to withdraw from a distance contract in accordance with the Consumer Affairs Act and applicable Maltese rules on withdrawal from distance contracts.
  6. This chapter does not apply to Entrepreneurs. The consumer provisions set out in this chapter also apply, where applicable law so provides, to natural persons concluding a contract directly related to their business activity when it follows from the content of that contract that it is not of a professional nature for them.

§ 6 AMENDMENT OF THE TERMS AND CONDITIONS

  1. The Seller reserves the right to amend these Terms and Conditions for an important reason, which includes in particular:
    1. the need to adapt technical and IT solutions used in organising the Promotion to market conditions related to technical and IT progress.
    2. a change to existing generally applicable legal provisions or the introduction of new ones that have a direct impact on the content of these Terms and Conditions.
    3. the issuance of an administrative decision or court ruling resulting in an obligation to amend these Terms and Conditions.
    4. correction of obvious clerical errors.
  2. Amendments will not affect rights acquired by Participants. Amendments will be published one day in advance. Participants who do not accept the new Terms and Conditions may withdraw from participation in the Promotion.

§ 7 FINAL PROVISIONS

  1. Participation in the Promotion means acceptance of these Terms and Conditions.
  2. In matters not regulated by these Terms and Conditions, the provisions of the online store terms and conditions of www.mexen.mt and applicable Maltese and EU law shall apply.
  3. These Terms and Conditions are valid for the duration of the Promotion specified in §1 point 4.
